California Privacy Notice

(For California Residents)

Effective Date: November 20, 2025

This California Privacy Notice supplements the Zobtopia Privacy Policy and applies solely to individuals who reside in the State of California (“consumers” or “you”) when we act as a “business” under the California Consumer Privacy Act of 2018, as amended by the California Privacy Rights Act of 2020 (together, the “CCPA”).

It explains:

  • What categories of personal information we collect
  • The purposes for which we use that information
  • Whether and how we disclose, “sell,” or “share” that information
  • Your privacy rights under the CCPA and how to exercise them California DOJ+1

This Notice does not apply where we process information solely as a service provider on behalf of an Institution (for example, when we process Student Data for a school or district under FERPA or similar laws). In those cases, our use of information is governed by our agreements with the Institution and our main Privacy Policy, and some rights may need to be exercised through the Institution.

Any capitalized terms not defined in this Notice have the meaning given in our Privacy Policy.

1. Categories of Personal Information We Collect

In the last 12 months, we may have collected the following categories of personal information about California residents, as defined by the CCPA. Not every category will apply to every individual.

The examples below are illustrative. Actual data elements depend on how you interact with us (for example, as a Student, Educator, parent, or website visitor).

Student Data to create marketing profiles for
Students.

and password for your Zobtopia account, or
similar credentials provided by your Institution for
SSO. We do not intentionally collect financial
account numbers, precise geolocation, or other
SPI categories described in the CCPA.
Directly from you or your Institution when accounts are created or integrated

We collect these categories of personal information from:

  • You, when you interact with our Site or Platform, fill out forms, or communicate with us
  • Your Institution, when it provides Student or Educator information to set up and manage accounts
  • Your device, through automated technologies such as server logs and cookies
  • Our service providers, who assist us in operating and securing the Site and Platform

2. Purposes for Collecting and Using Personal Information

We collect, use, and retain personal information for the purposes described in our Privacy Policy and for the following CCPA purposes:

  • Providing and maintaining services
    • Operating the Site and Platform, authenticating Users, enabling classes, groups, and learning activities, and providing support
  • Supporting educational programs
    • Helping Institutions and Educators monitor Student progress, understand engagement, and adjust instruction
  • Improving and developing services
    • Analyzing usage trends, testing features, developing new content, and improving our user experience
  • Communicating with you
    • Responding to inquiries, sending administrative notices, and providing information about Platform changes or educational opportunities
  • Security and fraud prevention
    • Protecting against, identifying, and responding to security incidents, misuse, or fraudulent activity
  • Legal and compliance purposes
    • Complying with laws and regulations, enforcing our Terms of Service, and protecting our rights or the rights of others

We collect and use personal information only to the extent that is reasonably necessary and proportionate to achieve these purposes or for other compatible purposes disclosed in advance, consistent with the CCPA.

3. Disclosure of Personal Information

In the last 12 months, we may have disclosed the categories of personal information listed above to the following categories of recipients:

  • Institutions and Educators
    • Student Data, usage data, and related information are shared with the Institution and its authorized staff to support educational purposes.
  • Service providers and contractors
    • Companies that provide hosting, storage, authentication, analytics, email delivery, customer support tools, and similar services, under contracts that limit their use of personal information to providing services to us.
  • Professional advisors
    • Lawyers, auditors, and accountants, where necessary to obtain advice or protect our legal interests.
  • Governmental or legal authorities
    • When required by law, regulation, or legal process, or when necessary to protect the rights, safety, or property of Zobtopia, our Users, or others.
  • Successor entities
    • In connection with a merger, acquisition, reorganization, or sale of assets, subject to appropriate confidentiality and security protections.

We do not disclose Student Data to third parties for their own independent marketing purposes.

4. Sales and “Sharing” of Personal Information

Under the CCPA, “sale” and “sharing” have specific meanings that can include certain types of data disclosure or cross- context behavioral advertising, even if no money changes hands.

As of the Effective Date of this Notice:

  • We do not sell personal information of California residents as that term is defined under the CCPA.
  • We do not share personal information of California residents for cross-context behavioral advertising.
  • We do not sell or share Student Data.

If this ever changes, we will update this Notice and our Privacy Policy, and we will provide any required “Do Not Sell or Share My Personal Information” links or mechanisms as required by law.

Because we do not sell or share personal information in this way, we do not offer a “Do Not Sell or Share” opt out at this time.

5. Retention of Personal Information

We retain personal information for as long as reasonably necessary to:

  • Provide the Site and Platform and fulfill the purposes described in this Notice and our Privacy Policy
  • Support the educational programs of our Institutional customers
  • Comply with legal, regulatory, and contractual obligations
  • Resolve disputes and enforce our agreements

The length of time we retain each category of personal information may vary depending on:

  • The nature of the information and the relationship with the consumer or Institution
  • Legal and regulatory requirements
  • The Institution’s instructions
  • Our operational and security needs

For Student Data, our general practice is to retain information for the duration of the Institution’s relationship with Zobtopia, unless the Institution requests deletion earlier or a longer retention period is required or permitted by law or by our agreement with the Institution.

We may retain aggregated or de-identified information that no longer identifies an individual, for analytics, research, and
product improvement.

6. Your Privacy Rights Under the CCPA

If you are a California resident, you may have the following rights with respect to your personal information, subject to certain exceptions and limitations:

6.1 Right to know / access

  • You may have the right to request that we disclose the categories and specific pieces of personal information we have collected about you, the sources of that information, the purposes for which we collected it, and the categories of third parties to whom we disclosed it.

6.2 Right to deletion

  • You may have the right to request that we delete personal information we have collected from you, subject to certain exceptions (for example, where we need the information to provide services you requested, comply with legal obligations, or protect security).

6.3 Right to correct

  • You may have the right to request that we correct inaccurate personal information we maintain about you.

6.4 Right to know about sales or sharing and right to opt out

  • You may have the right to request information about whether we “sell” or “share” your personal information and the right to opt out of such sales or sharing. As noted above, we do not currently sell or share personal information as those terms are defined under the CCPA.

6.5 Right to limit use and disclosure of sensitive personal information

  • You may have the right to limit certain uses or disclosures of your sensitive personal information. At this time, we only use sensitive personal information (such as login credentials) for purposes that are considered necessary to provide the services and do not use or disclose it in ways that trigger this right.

6.6 Right to non-discrimination

  • You have the right not to receive discriminatory treatment for exercising your privacy rights under the CCPA.

Student Data and FERPA

When we process Student Data solely on behalf of an Institution, our role is generally that of a service provider or “school official” under FERPA or similar laws. In these cases:

  • Requests to access, correct, or delete Student Data may need to be directed first to the Institution, which controls the data and is in the best position to verify identity and determine what is appropriate under applicable education laws.
  • We will support the Institution in responding to such requests consistent with our contractual obligations and applicable law.

7. How to Exercise Your CCPA Rights

To submit a request under the CCPA, you or your authorized agent can contact us using one of the methods below:

  • Online form: Use the contact form on our Site at https://www.zobtopia.com/contact/ and indicate that your request is a “California privacy request”

When you submit a request, we may need to verify your identity to protect your privacy and the security of personal information. Verification steps may include:

  • Matching information you provide with information we already maintain
  • Requesting additional information reasonably necessary to confirm your identity
  • Confirming your relationship with an Institution, where relevant

If you use an authorized agent, we may require proof of the agent’s authorization and may ask you to verify your identity directly with us.

We will respond to verifiable consumer requests within the timeframes required by the CCPA, generally within 45 days, with a possible 45-day extension where reasonably necessary and as permitted by law.

Please note:

  • For Student Data, we may need to direct your request to the appropriate Institution or act only on that Institution’s instructions.
  • Certain information may be exempt from some CCPA rights because it is regulated by other laws (such as FERPA) or because it is necessary to retain for legal or security reasons.

8. Non Discrimination

We will not discriminate against you for exercising any of your CCPA rights. This means that, in response to a valid exercise of your rights, we will not:

  • Deny you goods or services
  • Charge you different prices or rates for goods or services
  • Provide you a different level or quality of goods or services

We may, however, offer different service tiers or features that involve different types or amounts of personal information, as permitted by law.

9. Children and Minors

We recognize that additional protections apply to children and minors under both federal and California law. We describe our children’s privacy practices and our compliance with COPPA and applicable student privacy laws in our main Privacy Policy.

As noted above:

  • We do not sell or share the personal information of minors under 16.
  • Children under 13 use our Platform only in limited, supervised circumstances (for example, through their school or with parental consent), and we collect only the personal information reasonably necessary to provide the educational services.

10. Changes to This California Privacy Notice

We may update this California Privacy Notice from time to time to reflect changes in our practices, technologies, or legal requirements.

When we make changes, we will:

  • Post the updated Notice on our Site with a new Effective Date at the top, and
  • Provide additional notice where required by law, such as in platform notices or emails to Institutional contacts

Your continued use of our Site or Platform after the Effective Date of an updated Notice means you acknowledge the changes. If you do not agree with the updated Notice, you should stop using our services.
